Terms and Conditions

Welcome to Samsara Wellness, owned and operated by SAMSARA INNOVATIONS PVT LTD (“we,” “our,” or “us”).

These Terms and Conditions (“Terms”) govern your use of the Samsara Wellness mobile application (“App”). By downloading, accessing, or using the App, you agree to abide by these Terms. If you do not agree, please do not use the App.

1.Eligibility and User Agreement

You must be at least 17 years old to use the App. If you are under 17, you may only use the App with the involvement and explicit consent of a parent or legal guardian.

By using the App, you represent and warrant that you meet the age requirement and have the legal capacity to enter into this agreement. You agree to provide truthful, accurate, current, and complete information when using the App and to update such information to keep it accurate.

By using the Services, you acknowledge and agree that the Wellness Professionals including medical practitioners providing support through the App may be located remotely and may not be based in your country or state of residence.

You understand and agree that the services provided by the Wellness Professionals are not intended to replace in-person sessions or to provide medical diagnosis, prognosis, treatment, or cure for any disease, condition, disorder, or disability. These services do not constitute state-regulated health care in your jurisdiction but are designed to offer supportive, enabling, and empowering guidance to improve wellness.

2.Important Definitions 

1. 1. “Wellness Professionals” shall refer to individuals who are certified or licensed practitioners in fields related to health and wellness, including but not limited to yoga instructors, dieticians, Ayurvedic practitioners, nutritionists, and wellness coaches. All such professionals featured on the App undergo verification of their credentials and their profiles can be accessed for details about their qualifications and services.

1. 1. “Wellness Services”/ “Services” shall mean and include services offered by the Wellness Professionals including, but not limited to, personalized fitness coaching, dietary planning, yoga instruction, lifestyle counselling, and holistic wellness guidance as facilitated through the App.

3.Data Collection and Use

We collect personal and medical information including sensitive health data with explicit consent, necessary to provide health tracking and Wellness Services and recommendations. This data is processed according to our Privacy Policy, which you must review and accept before using the App.

Your data is used to personalize Wellness Services, generate health tracking insights, manage your account, and facilitate communication with Wellness Professionals and third-party service providers.

We implement robust security and data protection measures and comply with applicable global privacy regulations including GDPR, CCPA, DPDP Act, HIPAA, and PDPA.

4.Health Tracking and AI-Enabled Recommendations

The App uses third-party AI technology to analyze your health data and generate generic nutrition, diet, and wellness plans.

These AI-generated recommendations are intended as general guidance only and are not a substitute for professional medical advice. Accuracy cannot be guaranteed; results vary by individual.

We do not encourage or advertise replacing professional medical advice with AI-generated content, which is intended for informational purposes only. You are advised to consult qualified professionals before making health decisions.

We do not use your personal data to train third-party AI models.

5.Disclaimer

Samsara Wellness is not designed to handle medical or psychological emergencies. It does not provide support for crisis situations such as thoughts of self-harm, suicide, or severe clinical disorders including schizophrenia and other psychotic conditions.

If you are experiencing a crisis or emergency, such as abuse, severe mental health conditions, suicidal ideation, harm to yourself or others, or any urgent situation, you should immediately contact appropriate emergency or crisis services in your area.

6.User Responsibilities

By accessing and using the Samsara Wellness App, you agree to act responsibly, ethically, and in compliance with all applicable laws and regulations. Specifically, you agree that you will not:

1. Provide false, misleading, or incomplete information during registration, profile setup, or while using any feature of the App; Impersonate another individual, misrepresent your identity, or create multiple accounts for deceptive purposes; Falsify health data, medical history, or wellness goals that may impact AI-generated suggestions or professional consultations. You not and understand that accurate information is essential for meaningful wellness tracking and recommendations.

1. Use the App for any illegal, unauthorized, or unethical purposes, including but not limited to activities that violate local, national, or international laws such as fraud, harassment, infringement of intellectual property rights, or dissemination of harmful content.

1. Post, share, or distribute content that is obscene, offensive, abusive, defamatory, discriminatory, hateful, threatening, invasive of privacy, or otherwise objectionable or illegal. This includes material that promotes violence, hatred, or discrimination.

1. Rely exclusively on AI-generated wellness recommendations or automated responses for medical, psychological, nutritional, or any health-related decisions. Such advice is intended for general informational purposes and should never substitute for consultation with qualified healthcare or wellness professionals.

1. Use the App in any manner that could disrupt, degrade, damage, or interfere with the normal functioning, security, or availability of the App or its associated services and infrastructure. This includes attempts to bypass security measures, introduce malware, or overload systems.

1. Attempt to gain unauthorized access to any other user’s account, data, or the App’s backend systems.

1. Introduce malware, viruses, or harmful code that may compromise data security or user experience.

1. Engage in behaviour that adversely impacts other users’ ability to use and benefit from the App.

Failure to comply with these responsibilities may lead to immediate suspension or termination of your account, removal of content, and, if appropriate, legal action.

You further agree to:

• Interact respectfully with wellness professionals and other users.
• Refrain from abusive, discriminatory, or inappropriate behaviour during consultations, messaging, or community participation.
• Honor scheduled appointments, payment obligations, and feedback protocols when engaging with professionals.

7.Grievance Redressal

If you have any complaints or grievances regarding the App or services provided, please contact our grievance officer at support@samsarawellness.in. We commit to acknowledge your complaint within 3 business days and aim to resolve the issue promptly in accordance with applicable laws.

8.Intellectual Property Rights

All content, trademarks, logos, and data (except for personal data shared by you) on the App are the exclusive property of SAMSARA INNOVATIONS PVT LTD or its licensors. Unauthorized use or reproduction is prohibited.

9.Indemnity

You agree to indemnify, defend, and hold harmless SAMSARA INNOVATIONS PVT LTD, its affiliates, officers, directors, employees, agents, licensors, and service providers (collectively, the “Indemnified Parties”) from and against any and all claims, liabilities, damages, losses, costs, expenses, or demands (including reasonable attorneys’ fees and legal costs) arising out of or related to:

• Your use of, or conduct in connection with, the Samsara Wellness App and Services;
• Any violation or alleged violation by you of these Terms or applicable laws and regulations;
• Any breach of your representations, warranties, or obligations under these Terms;
• Your submission of any content that is false, misleading, infringing, unlawful, defamatory, obscene, or otherwise objectionable;
• Your interaction with any third-party Wellness Professionals or reliance on their advice or services;
• Any claim that your use of the App or the Services has caused harm to a third party.   

10.Limitation of Liability and Disclaimers

The App is provided “as is” without warranties of any kind, express or implied. We do not guarantee the accuracy, applicability, or completeness of any health or wellness information shared.

Samsara Wellness acts solely as a facilitation platform connecting you with Wellness Professionals. We do not provide any professional health, medical, psychological, or wellness services ourselves. All professionals featured on the App are independent third parties, responsible for their own services and advice.

While we take reasonable steps to verify the credentials of the Wellness Professionals, we make no representations or warranties regarding the qualifications, expertise, performance, or suitability of any third-party professional or their services. Your use of these services is at your sole risk and discretion.

Samsara does not guarantee the accuracy, completeness, or effectiveness of any health, nutrition, or wellness information provided by the App, including AI-generated recommendations or advice issued by Wellness Professionals. Such information is for general informational purposes only and should not replace consultation with qualified professionals.

To the fullest extent permitted by applicable law, SAMSARA INNOVATIONS PVT LTD., including its affiliates, officers, employees, licensors, and service providers, shall not be liable for any:

• Direct, indirect, incidental, special, consequential, or punitive damages;
• Errors, omissions, or inaccuracies in content or services;
• Losses or damages arising from your reliance on AI-generated content or third-party professional services;
• Personal injury, mental health conditions, or property damage resulting from use of the App or engagement with any Wellness Professional;
• Interruptions, delays, or failures in the operation or delivery of the App or Services;
• Unauthorized access to or alteration of your data or communications.

You acknowledge and agree that the Services through the App are not a substitute for professional medical, psychological, or other licensed advice, diagnosis, treatment, or emergency services. In urgent or emergency situations, you should seek appropriate in-person care immediately.

This limitation applies regardless of whether liability arises in contract, tort, negligence, strict liability, or otherwise. Some jurisdictions may not allow the limitation or exclusion of certain liabilities; in such cases, liability is limited to the maximum extent permitted by law.

By using the App, you expressly waive any claims against Samsara Wellness beyond the extent permitted in this clause.

11.Payments and Payment Terms

Some features or services available through the Samsara Wellness App may require payment or subscription fees (“Paid Services”). By opting to use any Paid Services, you agree to the following terms:

• All fees for Paid Services will be clearly disclosed before purchase or subscription. Payments must be made through the authorized payment methods available in the App.

• For subscription-based services, fees will be charged on a recurring basis as per the selected plan (e.g., monthly, annually). You authorize us or our payment processors to charge your chosen payment method accordingly.
• Unless otherwise specified, payments for Paid Services are non-refundable. You may cancel subscriptions at any time through your account settings; however, cancellation will typically prevent renewal and not result in a refund for the current billing period.

• We reserve the right to modify pricing or fees with prior notice. Continued use of Paid Services after any fee change constitutes acceptance of the new charges.

• You are responsible for any taxes, duties, or levies imposed on your purchase of Paid Services.

• If a payment fails or is declined, we may suspend or terminate your access to Paid Services until payment is received.

• By subscribing or purchasing, you confirm the accuracy of the payment information provided and agree to pay all associated fees.

12.Termination of Use

We reserve the right to suspend or terminate your access to the App at our sole discretion, without prior notice or liability, if you violate these Terms or engage in unauthorized or harmful conduct.

Upon termination, your right to use the App will cease immediately. Termination will not affect any rights or remedies that may have accrued to us.

13.Term

These Terms shall come into effect when you first access or use the Samsara Wellness App and will continue to govern your use of the App and Services until terminated. Your right to use the App will remain valid unless:

• You choose to terminate your account by following the prescribed account deletion process, or

• We terminate or suspend your access in accordance with these Terms, including for violations of the Terms or applicable laws.

We reserve the right to modify, suspend, or discontinue the App or any portion of the Services at any time without prior notice. Termination or suspension will not relieve you of any outstanding obligations or liabilities incurred prior to termination. Upon termination, all rights granted to you under these Terms will immediately cease, and you must stop using the App and Services.

14.Governing Law and Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of India. Any disputes arising out of or relating to these Terms or your use of the App shall be subject to the exclusive jurisdiction of the courts located in Bengaluru, Karnataka, India.

15.Entire Agreement

These Terms, together with the Privacy Policy and any other legal notices or policies published by SAMSARA INNOVATIONS PVT LTD in relation to the Samsara Wellness App, constitute the entire agreement between you and us regarding your use of the App and Services. They supersede all prior or contemporaneous communications, proposals, or agreements, whether oral or written, relating to the subject matter herein.
